Why Care About AI?
If you’ve been reading my newsletters, you know that Texas and Arizona have adopted the American Bar Association’s comments regarding maintaining technological competency. In 2012, the ABA modified comment No. 8 to their Model Rule 1.1 to explicitly mention the use of technology. Under the heading “Maintaining Competence,” it reads (in relevant part):
[8] To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology… [emphasis added].
Moreover, the ABA issued its first opinion on GenAI, which was highlighted in the last edition.
In addition to the reasons mentioned above for caring about AI, Karl Epps gives a more sinister reason, including more sophisticated phishing attempts, deepfakes, and malware. Check out his article (reprinted with permission).
